Seven-Word Lessons

TERMS OF PARTICIPATION

By submitting a seven-word lesson appropriate for grades K-8 (“Lesson”) for consideration for use as part of the Seven-Word Lessons program (“Program”), you (“Applicant”) agree to abide by these Terms of Participation, the Terms of Use and Privacy Policy, and the decisions of WorkInProgress (“WIP”), which shall be final and binding in all respects relating to this Program. In the event of a dispute between these Terms of Participation and the Terms of Use, these Terms of Participation shall govern over any matter directly related to this Program or materials submitted as part of this Program.

WHO CAN PARTICIPATE: Applicants must be legal U.S. residents who are educators. Applicant must be able to provide proof of being an educator in a form acceptable to WIP to be eligible (e.g. link to Applicant’s LinkedIn profile, classroom page, etc.). Employees, temporary workers, freelancers and independent contractors, and their immediate families (spouse and parents, children, siblings and their respective spouses, regardless of where they reside) and those persons living in their same households, whether or not related, of WIP, its parent, affiliates, subsidiaries, and/or advertising and promotion agencies are not eligible.

HOW TO SUBMIT A LESSON: Between 12:00 AM Eastern Time (“ET”) on 5/7/2020 and approximately 12:00 AM ET on 6/12/2020 (“Lesson Submission Period”), to submit a Lesson, visit here (“Site”) and follow the directions provided to complete and submit the application form. Lesson must be exactly seven (7) words. No more and no less. Lesson Submission Period is subject to change at WIP’s discretion and any changes will be posted on the Site. There is no limit on the number of Lessons any Applicant can submit; however, each Lesson must be submitted separately and be substantially different than any other Lesson submitted by that Applicant, as determined by WIP in its sole discretion. In the event the exact same or similar Lesson is submitted by more than one person, WIP will decide, in its sole discretion, which (if any of such Lessons) to select. All Lessons become the property of WIP. Lesson must be your own original work, cannot be inappropriate or obscene, promote any particular political or educational agenda or infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity, as determined by WIP, in its sole and absolute discretion. WIP has full discretion as to the number of Lessons it selects and reserves the right to not select Lessons through this process.

GRANT OF RIGHTS TO LESSON/PUBLICITY GRANT:  By submitting a Lesson, Applicants agree and hereby grant to WIP and its designees, successors, licensees and assigns an unlimited, perpetual, irrevocable, assignable, royalty-free, fully paid-up license to reproduce, distribute, create derivative works of, edit, alter, display, exhibit, combine with other materials, exploit and otherwise use the Lesson (and agrees to waive all moral rights thereto), and all elements, content or statements embodied therein, including, but not limited to, Applicant’s name, teacher title, class name/description, and city and state of residence, in whole or in part, in any manner and in any and all media now known or hereafter devised throughout the universe for any purpose whatsoever, including, without limitation, for commercial purposes, without compensation (other than as agreed to in advance by WIP) or notification to, or permission from, Applicant or any third party.

LESSON SCREENING AND SELECTION PROCESS: All Lessons will be reviewed by WIP.  Applicants whose Lesson is selected for use by WIP will be contacted by text or email and will receive $25 (or other amount to be determined by WIP but at no time will payment be less than $25) via Venmo from WIP using the mobile phone number provided at time of Lesson submission. Applicants must have or establish a Venmo account in order to receive payment for the Lesson. Creating a Venmo account is free. All applicable Venmo terms apply. Applicants whose Lessons are selected by WIP as a result of this Program will not be employees of WIP.

GENERAL CONDITIONS:  Void where prohibited by law. This Program is subject to all applicable federal, state, and local laws. By submitting a Lesson, Applicants agree (a) to release, discharge, hold harmless and indemnify WIP, its parent, affiliates, subsidiaries, and advertising and promotion agencies, any applicable social media platform, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind (including, without limitation, arising from claims based upon copyright infringement, trademark infringement, invasion of privacy, defamation, or right of publicity) to persons, including death, or property resulting, in whole or in part, directly or indirectly, from Applicant’s participation in the Program, submission process and/or the use of any Terms of Participation, in whole or in part, in any manner by WIP in connection with the Program; and (b) to the use by WIP and its designees of Applicants’ names, biographical information, cities and states of residence, and Lesson content for advertising, publicity, promotional and trade purposes in any and all media, now or hereafter known, in any manner, worldwide in perpetuity, without compensation (unless prohibited by law or otherwise agreed upon by the parties) or additional consents from Applicants or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so. 

Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled Lessons, emails, payments or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Program or the Lesson submission process, including, without limitation, errors or difficulties which may occur in connection with the administration of the Program or in any Program-related materials.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program.  Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in the Program or use of the Site. Persons who tamper with or abuse any aspect of the Program or Site, who act in an unsportsmanlike or disruptive manner or who are in violation of these Terms of Participation, as solely determined by WIP, will be disqualified. WIP reserves the right at its sole discretion to suspend, modify or terminate the Program at any time and for any reason. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WIP RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
